1. Agreement
These Terms govern your access to and use of Proxfit's mobile application, the proxfit.app website, and related services (together, "Proxfit"). Proxfit is operated by Proxfit LLC, an Illinois limited liability company.
By creating an account, accepting these Terms in the app, or using Proxfit, you agree to them. If you do not agree, do not use Proxfit.
Proxfit is currently offered in the United States only.
2. Eligibility
You must be at least 16 years old to use Proxfit. This floor is set globally and applies regardless of where you access the app. A store download, an age rating, or a parent or guardian's approval does not make a person under 16 eligible, and Proxfit does not offer a guardian-consent process that would.
If you are under the age of legal majority where you live, you may use Proxfit only where applicable law and the app store's rules permit, and where any required parent or guardian approval has been obtained. If applicable law requires a higher age to enter into these Terms or to purchase a subscription, you must meet that higher age.
You confirm that the registration information you give us is accurate and that you are eligible. We may suspend and delete an account that is not.
Platform approval of a purchase does not by itself give a parent or guardian access to a user's Proxfit account or personal information. Privacy-request verification rules still apply.
3. A fitness and wellness service, not medical advice
Proxfit provides general fitness and wellness information, workout planning, exercise substitutions, readiness-informed adjustments, and progress tracking, based on information you give us.
Proxfit is not a medical device. It does not diagnose, treat, cure, prevent, mitigate, or rehabilitate any disease, injury, or medical condition. It does not provide physical therapy, emergency services, or professional medical advice, and it does not replace a physician, physical therapist, certified trainer, or other qualified professional.
When you tell Proxfit about an injury or pain, Proxfit records what you reported and applies rules to the exercises it selects. It does not assess you, form a view about what is wrong, judge how severe it is, or decide whether you have healed. Do not use Proxfit to decide whether an injury is safe to train through, or whether you are ready to return to activity. Those are questions for a qualified professional.
4. Exercise carries risk, and the decision to train is yours
Exercise can cause injury or other harm. You are responsible for deciding whether to take part, for using suitable equipment and technique, for following the rules of the facility and equipment you use, for arranging appropriate supervision, and for staying within your own capabilities.
Consult a qualified professional before starting or changing an exercise program, particularly if you have an injury, pain, or a health condition, are pregnant, or are returning to exercise after time away.
Stop exercising and seek appropriate help if you experience pain, dizziness, faintness, chest pain, unusual shortness of breath, numbness, weakness, or other concerning symptoms. Call emergency services in an emergency. Proxfit is not a channel for urgent help and no one monitors it for emergencies.
Proxfit applies automated constraints to the exercises it selects. Those constraints reduce unsuitable selections; they do not make any workout safe or suitable for you. The information you give us may be incomplete or wrong, and a generated selection may contain errors.
5. How workouts are generated
Workouts are generated and arranged by software, using rules and an optimization process that runs on Proxfit's own servers. Where an external AI service is enabled for a feature, its output is advisory only and is validated or rejected by deterministic rules before you see it. Software output is not a professional opinion.
Proxfit does not guarantee the accuracy, completeness, safety, availability, or results of a generated workout, or that it is fit for any particular purpose. Do not present generated content to anyone as a prescription, a treatment plan, or medical clearance.
6. Your account
Keep your credentials secure, use your own account, and tell us at support@proxfit.app if you think your account has been compromised. We may require you to re-authenticate.
You may not probe, disrupt, scrape, or reverse engineer the service, abuse invitations or promotions, bypass access controls, or use Proxfit unlawfully. We may suspend access to protect users or systems.
7. Subscriptions, trials, and renewals
Paid access to Proxfit is sold through the Apple App Store, as an auto-renewing subscription at $12.99 per month or $109.99 per year in US dollars. New subscribers are offered a 14-day free trial. Prices are set in App Store Connect and the App Store purchase screen is what controls: it states the product, the billing period, the price, any trial or promotional terms, the renewal price, and any material conditions before you buy.
If you start a free trial and do not cancel it at least 24 hours before it ends, it converts into a paid subscription at the price shown, and the App Store charges the payment method on your Apple account.
Subscriptions renew automatically. Unless you cancel through the App Store at least 24 hours before the end of the current period, the subscription renews for another period at the then-current price and the App Store charges your payment method. You can see and cancel your subscription at any time in your Apple account settings under Subscriptions.
Deleting the Proxfit app does not cancel a subscription. Cancelling a subscription does not delete your Proxfit account or your data; account deletion is a separate request described in the Privacy Policy.
We may change prices. A change to the price of an existing subscription takes effect at the next renewal, and Apple will notify you and, where required, ask you to consent before it applies.
Promotional offers, including any discount offered to former beta testers, may have eligibility, territory, redemption, duration, renewal, lapse, and stacking limits. Unless a specific written offer says otherwise, a promotional offer is discretionary and may be changed or withdrawn before it is granted.
8. Cancellation and refunds
Cancel through the App Store. Because Apple processes the purchase, refunds are governed by Apple's process and by applicable law, and are requested from Apple rather than from Proxfit, except where we expressly agree otherwise.
Access is controlled by our server records, and what the app displays can take a short time to catch up after a purchase, restore, or cancellation. If your access does not match what you bought, contact support@proxfit.app.
9. Privacy
The Privacy Policy at proxfit.app/privacy describes what we collect, how we use it, who processes it, how long we keep it, and the rights you have. It forms part of your agreement with us.
Do not submit another person's health, injury, or account information without their authority. Do not put medical records, diagnoses, or emergency contact details into free-text fields; Proxfit does not need them and does not use them.
10. Suspension and termination
We may suspend or end access for ineligibility, safety, abuse, fraud, a security problem, non-payment or an expired entitlement, a legal requirement, or a material breach of these Terms. Where it is appropriate and legally permitted, we may do so without advance notice.
Suspension does not by itself delete your data. You may request deletion at any time from Settings in the app or by emailing privacy@proxfit.app, subject to the retention exceptions described in the Privacy Policy.
11. Intellectual property
Proxfit LLC and its licensors own the service, the software, the branding, the workout content, and the exercise media. Subject to these Terms, we grant you a personal, limited, revocable, non-transferable, non-sublicensable licence to use the app for your own fitness activities.
You may not redistribute the exercise media, use the service to build a competing dataset or product, remove proprietary notices, or commercially exploit the content.
You keep your rights in the information you submit. You grant us the rights we need to host, process, adapt, transmit, and use it in order to provide, secure, support, and improve the service, as described in the Privacy Policy.
12. Third-party services
Proxfit relies on third parties for identity, subscription management, hosting and network security, and email. Those services are governed by their own terms.
Apple is responsible for the App Store and for its purchase and refund systems. Apple is not responsible for Proxfit's workout content or for the service itself.
13. Disclaimers
To the maximum extent permitted by law, Proxfit is provided "as is" and "as available", without warranties that may lawfully be disclaimed, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
Nothing in these Terms excludes or limits any warranty, remedy, or consumer right that cannot lawfully be excluded or limited. Where a limitation is not permitted, it does not apply to you.
14. Limitation of liability
To the extent permitted by law, Proxfit LLC is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, or loss of goodwill, arising out of or relating to your use of Proxfit.
To the extent permitted by law, Proxfit LLC's total liability for all claims relating to Proxfit in any twelve-month period is limited to the greater of the amount you paid us for Proxfit in that period and one hundred US dollars.
These limits do not apply to liability that cannot lawfully be limited. In particular, nothing in these Terms limits or excludes liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else applicable law does not permit us to limit. Some jurisdictions do not allow the exclusion of certain damages, so parts of this section may not apply to you.
15. Governing law and disputes
These Terms are governed by the laws of the State of Illinois, without regard to its conflict-of-laws rules, except that this choice does not deprive you of the protection of mandatory consumer-protection rules of the state where you live.
Before starting a formal proceeding, please contact us at support@proxfit.app and give us 30 days to try to resolve the matter informally. Most issues are resolved this way.
The state and federal courts located in Illinois have jurisdiction over any dispute that is not resolved informally. Nothing here prevents you from bringing a claim in a small-claims court, or from reporting a concern to a regulator or consumer-protection agency.
These Terms do not contain a mandatory arbitration clause or a class-action waiver.
16. Apple-required terms
This section applies to the Proxfit app obtained from the Apple App Store, and applies in addition to the rest of these Terms.
These Terms are between you and Proxfit LLC only, not with Apple. Proxfit LLC, not Apple, is solely responsible for the app and its content.
Your licence to use the app is a non-transferable licence to use it on any Apple-branded device that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms of Service.
Apple has no obligation to provide maintenance or support for the app. If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price of the app; to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app.
Proxfit LLC, not Apple, is responsible for addressing any claim by you or a third party relating to the app, including product-liability claims, any claim that the app fails to conform to a legal or regulatory requirement, and claims under consumer-protection or similar legislation. Proxfit LLC, not Apple, is responsible for the investigation, defence, settlement, and discharge of any third-party claim that the app infringes that party's intellectual property rights.
You represent that you are not located in a country subject to a US Government embargo or designated as a "terrorist supporting" country, and that you are not listed on any US Government list of prohibited or restricted parties.
Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and on your acceptance of these Terms Apple will have the right to enforce them against you as a third-party beneficiary.
Questions, complaints, or claims about the app should be directed to support@proxfit.app.
17. Changes to these Terms
We may update Proxfit and these Terms. Each published version carries a version identifier and an effective date, and the version you accepted is recorded against your account.
When we make a material change, we will ask you to accept the new version before you continue using Proxfit. Changes do not reduce your rights retroactively where that is prohibited.
